Terms of Service (TOS) & Acceptable Use Policy (AUP)

Applies to: Creighton Comp Hosting LLC, KC Hosting LLC, KC Dedicated Hosting LLC, WHMCS-IT LLC, and WHMCS Host LLC.

1. Acceptance

By using or purchasing any service you agree to these Terms. The TOS/AUP may be changed at any time with or without notice.

2. No Refund Policy

ALL SALES ARE FINAL. THERE ARE NO REFUNDS for any hosting service, VPS, dedicated server, software, design work, SEO, marketing, licenses, custom work, domain registrations, eBay purchases, promotions, specials, or any other product or service.

3. eBay Orders

Once login credentials or access information have been delivered for an eBay purchase, NO SUPPORT will be provided through eBay messages. Customers must contact us through our official support channels.

5. Prohibited Use

No spam, phishing, malware, hacking, DDoS, copyright infringement, child exploitation, terrorism, illegal content, crypto scams, fraud, unauthorized access, resource abuse, or activity violating applicable law.

6. Normal Website Resource Use

A normal website should stay around:

7. Server Resource Abuse Policy

Clients are responsible for keeping their websites, scripts, plugins, themes, and databases optimized and secure. Shared hosting accounts are intended for normal website hosting only and may not be used in a way that negatively affects server performance, stability, IP reputation, or other customers.

The following are considered abuse:

  • Sustained high CPU, RAM, MySQL, or disk I/O usage
  • Poorly optimized WordPress plugins, themes, or scripts
  • Malware, hacked scripts, phishing, or spam activity
  • Mass mailing, bulk email, or mailing lists without approval
  • Crypto mining, proxy services, bots, scanners, or traffic exchange sites
  • File hosting, backup storage, video streaming, or download mirrors
  • Cron jobs running too often or causing high load
  • Excessive inode/file count usage
  • Any activity that causes server load, blacklisting, crashes, or service disruption

We reserve the right to throttle, suspend, disable scripts, or terminate any account that causes server abuse or threatens server stability. No refunds will be issued for accounts suspended or terminated due to abuse, policy violations, spam, phishing, malware, chargebacks, or illegal activity.

8. Customer Responsibility

Customers are responsible for backups, account security, passwords, scripts, and software updates.

9. Chargebacks

Chargebacks or payment disputes may result in immediate suspension or termination and collection efforts where permitted by law.

10. Limitation of Liability

Services are provided AS IS and AS AVAILABLE. Liability is limited to the maximum extent permitted by law. We are not liable for data loss, downtime, or indirect damages.

11. Governing Terms

If any provision is unenforceable, remaining provisions remain in effect.
